Terms and Conditions Hotel Kint

  1. Agreement

Except for specific written provisions issued by an authorized person, these current general terms and conditions apply to all commitments of Hotel Kint, represented by Kint Operations BV.

These terms are mentioned on the website www.hotelkint.nl, thereby making them sufficiently known. Silent acceptance is evidenced by visiting our premises or receiving our documents or services.

  1. Payment Terms

Our invoices are payable on the invoice date without deduction. Individual guests must provide a credit card guarantee upon reservation, failing which the reservation will be automatically canceled. In case the invoice remains unpaid or partially unpaid after 30 days, the guest will owe a compensation of 5% on the invoice amount by operation of law. Interest and compensation are due solely by the fact of non-payment. Payments made after a delay in payment will first be applied to interest and compensation, and then to the invoice amount. Under no circumstances can non-occupation of the provided accommodations, an incomplete and/or contested stay and/or reservation and/or service by the guest be used as a pretext for a delay in payment. Any delay in payment grants the hotel the right to unilaterally and without compensation, cancel all existing and not yet executed agreements with the buyer, as well as suspend any performance of ongoing agreements.

  1. Description

The descriptions, sizes, colors, as well as details of photos and/or drawings in price quotes, catalogs, website, booking sites, and social media are purely informative and not binding.

  1. Check-in and Check-out

The reserved accommodations are available from 3:00 PM on the day of arrival and must be vacated by 11:00 AM on the day of departure. In case of a guest with a guaranteed reservation not showing up at the indicated time, the hotel has the right to charge the guest a compensation equal to the total reservation value, including any requested additional services.

  1. Complaints

Any complaint concerning the stay, goods, and/or invoice must be reported to the hotel by the guest as soon as possible during their stay, in order to provide the hotel the opportunity to address the complaint immediately.

In any case, the complaint must be made in writing, within eight days of delivery, service, and/or invoice, on pain of forfeiture.

  1. Force Majeure

In case of force majeure, unforeseeable events beyond its control and/or exceptional circumstances, the hotel reserves the right to accommodate the guest, without any form of compensation, at a colleague hotel, if possible in the vicinity.

  1. Damages

Any damages caused by the guest, whether to accommodations, furnishing goods, and/or others, belonging to or at the hotel/estate or owned by third parties with whom the hotel maintains relationships, will be paid in cash by the guest based on the hotel's accepted statement, without dispute, and no later than before the guest's departure. Regarding the parking of vehicles in the hotel's parking lots and garages, as well as in facilities owned by third parties with whom the hotel maintains relationships, it is agreed that the hotel is exempt from any responsibility, for any cause whatsoever, including but not limited to damages, theft, and/or disappearance of the vehicle or items attached to or inside it, as well as bodily injuries to guests or third parties that may have been caused by anyone/anything at these locations.

Hotel Kint is completely non-smoking. Smoking is therefore not allowed inside our buildings. This smoking ban also applies to the room/suites. If the management determines that the smoking ban has been violated, the fine/indemnity is €250 per violation.

  1. Disputes

In any dispute, regardless of where the act, service, or agreement takes place, only the court is competent, solely in accordance with Belgian law. Neither bills of exchange nor deviating payment terms change this competence. The guest accepts these general terms and conditions at the time of reservation. The guest declares to know, understand, and agree to these conditions and also to comply with the customary house rules of the hotel establishment and the instructions provided by the hotel staff. The hotel is entitled to terminate the provision of catering services to a guest at any time and without notice if the guest repeatedly violates the house rules or behaves in a manner that disrupts the order and tranquility of the catering establishment and/or its normal operation. The guest must then leave the hotel upon first request.

  1. General Conditions Events

Payment Terms:

After acceptance of the quote, a deposit of 50% will be requested, which must be paid within 7 days after the invoice date. Within 60 days before the start of the event, a second deposit of 25% will be requested, which must be paid within 7 days after the invoice date. If acceptance of the quote falls within 60 days before the start of the event, we will request a single deposit of 75%, which must be paid within 7 days after the invoice date. After completion of the event, the remaining 25% of the accepted quote + additional consumption based on actual calculation will be invoiced. This invoice must be paid within 7 days after the invoice date. Cancellation Conditions:

Up to 60 days before arrival, a maximum of 50% of the confirmed reservation can be canceled free of charge. From 60 to 30 days before the start of the event, a maximum of 25% of the confirmed reservation can be canceled free of charge. From 29 to 8 days before the start of the event, 90% of the reservation value will be invoiced. From 7 days until the day of the event, No show or earlier departure, 100% of the reservation value will be invoiced. Other Event Conditions:

Changes in numbers can be communicated up to 30 days before the start of the event, with a deviation of up to 20% being accepted. From 29 days before the start, any changes in numbers will be invoiced in full. Groups

Reservations from 5 rooms will be treated as a group reservation.

Payment Terms:

After acceptance of the price proposal, a deposit of 50% will be requested, which must be paid within 7 days after the invoice date. At check-out, the remaining 50% of the price proposal + additional consumption during the stay based on actual calculation will be settled on the spot. Cancellation Conditions:

Up to 60 days before arrival, a maximum of 50% of the confirmed reservation can be canceled free of charge. From 60 to 30 days before the start of the group, a maximum of 25% of the confirmed reservation can be canceled free of charge. From 29 to 8 days before the start of the group, 90% of the reservation value will be invoiced. From 7 days until the day of the group, No show or earlier departure, 100% of the reservation value will be invoiced.

Individual Reservations (1 to 4 rooms)

Payment Terms:

When making a reservation, credit card details will be requested as a guarantee for the reservation. If the reservation is made at a non-refundable rate, the credit card will be charged. Cancellation Conditions:

Free cancellation is possible up to 48 hours before arrival (until 3:00 PM two days before arrival). In case of cancellation less than 2 days before arrival, you will be charged the reservation value of the first night, including both accommodation and any reserved catering services. In case of no-show, the total reservation will be charged.

10. Credit Card Guarantee

Upon check-in, the guest shall provide a credit card, of which Hotel Kint will record the details. If the guest fails to make payment within the agreed-upon term or avails of facilities (e.g., bar, restaurant, etc.) without indicating them at check-out, the hotel shall have the right to charge the expenses to the credit card, on the sole condition that a detailed statement of the charges is provided to the guest, either electronically or by mail. In any case, the guest must raise a written protest within 8 days regarding any payment executed if they believe it was unjustified.

Article 1152 of the Civil Code (BW) is applicable in this matter.
